You need to look at the etching round the centre of the disc. If it reads MS02301L then it should work fine. If it reads MS02308L then it is an updated version and will not work.
This happened to me too and am currently trying to locate a "good" copy. Apparently you can use an original copy of Splinter Cell too and this can be had quite cheaply these days.
